These Terms of Sale (“Terms”) set out the agreement between The Yard Builders Merchant Ltd (“The Yard BM”, “we”, “our”, “us”) and you, the customer (“you”, “your”) when purchasing products through our Website https://theyardbm.co.uk, by phone, or by email.
By placing an order with us, you agree to these Terms, together with our Delivery Policy, Returns Policy, Privacy Policy, and Cookie Policy.
1. Orders
- Orders can be placed via our Website, by phone, or by email.
- All orders are subject to acceptance and product availability.
- You will receive an order confirmation email once your order is processed – please check it carefully.
- We reserve the right to refuse or cancel orders where products are unavailable, incorrectly priced, or where payment issues arise.
2. Pricing & Payment
- All prices are shown in GBP (£) and include VAT (where applicable).
- Delivery charges are calculated separately and displayed before you confirm your purchase.
- Payment must be made in full at the time of order, unless otherwise agreed (e.g., under an approved trade account).
- We accept major debit/credit cards, bank transfers, and other approved payment methods shown at checkout.
3. Delivery
Our Delivery Policy forms part of these Terms. Key points include:
- Standard delivery lead time: 3–5 working days for stocked items.
- Special order items: 7–10 working days (or as advised).
- Deliveries are kerbside only, unless otherwise agreed in advance.
- You must ensure safe and suitable access for delivery vehicles.
- A responsible person must be present to accept and sign for the goods.
- Risk of goods passes to you upon delivery.
4. Returns & Cancellations
Our Returns Policy forms part of these Terms. Key points include:
- You may cancel an order within 3 hours of placing it for a full refund.
- If you cancel more than 3 hours after placing your order, a £25 + VAT administration fee will apply.
- Consumers (non-business customers) have the right to return goods within 14 days of delivery under the Consumer Contracts Regulations 2013.
- Returned goods must be unused, in original packaging, and in resaleable condition.
- Return costs are your responsibility unless goods are faulty or misdescribed.
- Some items are non-returnable (e.g., bespoke, cut-to-size, or special-order products).
- Refunds are processed within 14 working days of us receiving and inspecting the returned goods.
5. Faulty or Damaged Goods
- You must notify us of faults, damage, or incorrect items within 48 hours of delivery.
- We may request photos or supporting evidence.
- If goods are confirmed as faulty or damaged, we will arrange a replacement, repair, or full refund (including standard delivery costs).
6. Trade Accounts
- Trade customers may apply for credit facilities, subject to approval.
- Payment terms, limits, and conditions will be confirmed in writing.
- Late payments may result in suspension of your account and interest charges as permitted by law.
7. Liability
- Our liability for any claim is limited to the purchase price of the goods concerned.
- We are not responsible for indirect, incidental, or consequential losses, including lost profits, downtime, or site delays.
- Suitability, installation, and use of products are your responsibility.
- Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
8. Governing Law
These Terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
